1. About these terms

These Terms of Use (“Terms”) govern your access to and use of the website at aashray.hostree.in and any related pages (the “Website”), operated by Aashray Realty (“Aashray Realty”, “we”, “us” or “our”), with its office at CS-1-11, Gate No. 3, Shopping Complex, Orris Residential Complex, Sector 85, Gurgaon – 122004, Haryana, India.

By browsing the Website, submitting an enquiry, or contacting us through it, you agree to these Terms, our Disclaimer and our Privacy Policy. If you do not agree, please do not use the Website.

2. Our services

Aashray Realty is a real-estate advisory and brokerage firm. We help clients buy, sell, rent and rent out resale and rental residential properties across Gurgaon (Gurugram). Our services may include property search, site visits, price and rent recommendations, screening of buyers, sellers, landlords and tenants, negotiation support, and document checks.

We act as an intermediary between parties. Unless expressly agreed in writing, we are not the owner, builder, developer, seller or landlord of any property shown or discussed, and we are not a party to the final sale deed, agreement to sell or lease/rent agreement between you and the other party.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to use our services. If you contact us on behalf of another person or a company, you confirm that you are authorised to do so.

4. Information you give us

When you fill in an enquiry form, call, WhatsApp or email us, you agree that:

• the information you provide (such as your name, phone number, email, requirement and preferred locality) is true, accurate and your own, or you have permission to share it;
• if you are an owner or landlord, you have the legal right to sell or let the property and the details you give us about it are correct;
• we may contact you by phone, SMS, WhatsApp or email about your enquiry and relevant properties, as described in our Privacy Policy.

5. Brokerage and fees

We do not charge advance fees for finding a property, buyer or tenant. Brokerage or service fees become payable only on a successful transaction, at the rate and on the terms agreed with you before the deal — ideally confirmed in writing, by email or by WhatsApp.

• Fees are generally payable on signing of the agreement to sell, sale deed or rent/lease agreement, or on handover, as agreed.
• Applicable taxes (such as GST) are payable in addition to the agreed fee, where applicable.
• If you close a deal directly with a party or property that we introduced to you, the agreed brokerage remains payable to us.
• Stamp duty, registration charges, society transfer charges, maintenance deposits and similar statutory or third-party costs are your responsibility and are not part of our fee.

6. Your responsibilities in a transaction

We personally check listings and review key documents, but the final decision to buy, sell, rent or let a property is yours. Before you commit or make any payment, you should:

• independently verify title, ownership, approvals, encumbrances, dues and possession status, with a lawyer where appropriate;
• make payments for the property only to the verified owner, landlord or their authorised representative through traceable banking channels — never in cash to an unknown person;
• read every agreement carefully before signing it.

7. Acceptable use of the Website

You agree not to:

• submit false, misleading or someone else’s details, or post fake listings or enquiries;
• copy, scrape, harvest or republish listings, photos, prices or contact details from the Website for commercial use;
• attempt to gain unauthorised access to the Website, its servers or data, or interfere with its working (including through viruses, bots or automated form submissions);
• use the Website for any unlawful purpose or in a way that breaches the Information Technology Act, 2000 or any other applicable law.

8. Intellectual property

The Aashray Realty name, logo, Website design, text, photographs and other content are owned by or licensed to Aashray Realty and are protected by applicable intellectual-property laws. You may view and print pages for your personal, non-commercial use. Any other use requires our prior written permission. Builder and project names mentioned on the Website belong to their respective owners and are used only to describe the areas and properties we cover.

9. Third-party links and services

The Website may link to or embed third-party services such as Google Maps or WhatsApp. We do not control those services and are not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms.

10. Disclaimer and limitation of liability

Property information on the Website is provided as described in our Disclaimer. To the fullest extent permitted by law, Aashray Realty, its partners and staff will not be liable for any indirect, incidental or consequential loss arising from your use of the Website, from reliance on any listing or price indication, or from the acts or omissions of any buyer, seller, landlord, tenant, builder or other third party.

Where we are found liable for a service we provided, our total liability will not exceed the brokerage or fee actually received by us for that specific transaction.

11. Indemnity

You agree to indemnify Aashray Realty against any claims, losses or costs that arise because you broke these Terms, provided false information, or misused the Website.

12. Changes to these terms

We may update these Terms from time to time. The revised version will be posted on this page with a new “Last updated” date. Continuing to use the Website after a change means you accept the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute will first be attempted to be resolved amicably through discussion. Failing that, the courts at Gurugram, Haryana will have exclusive jurisdiction.
